GSTAT to start operations by the end of FY25: Revenue Secy

The Goods and Services Tax Appellate Tribunal (GSTAT) is close to operationalization and should begin operations by the end of current financial year, according to Revenue Secretary Sanjay Malhotra’s  statement.

The GSTAT was established to settle disputes pertaining to GST. Concerns have been raised regarding the GST Appellate Tribunal’s operationalization.

“I want to reassure you that the GSTAT is getting close to its operationalization.” Malhotra stated at the State Bank of India’s (SBI) annual business and economic conference, “Hopefully, it should start functioning and hearing cases by the end of this financial year.”

In May 2023, Justice (Retd) Sanjaya Kumar Mishra was appointed as President of the GST Appellate Tribunal (GSTAT) by Union Finance Minister Nirmala Sitharaman.

As of August 2023, more than 14,000 GST appeals were still outstanding, according to a response to a legislative commission. Appeals against the first appellate authority’s decisions will be heard by GSTAT. It will include several state benches in addition to the Principal Bench in New Delhi.

At the event, the Revenue Secretary announced that the GSTAT will consist of approximately 44 benches nationwide, each consisting of four members. Three of these members will come from the central government, while one will come from a state government. Applications have been accepted by the Union government, and member interviews are complete.

About half of the places have been identified; the remaining locations are still in the process of selecting because we need to reserve the space. “Additionally, we have posted a need for employees to assist these members. Applications for these opportunities have been received. The staff and members for these benches will be selected very soon,” he continued.

Malhotra said that the GSTAT software is now available, enabling a completely paperless and computerized process. The IT infrastructure need to be procured, too.
