GST dept harassed CAs in a Fraud case; CA community call for protest

CGST Department Gurgaon opposite Medanta hospital have illegally held CAs hostage in the department. Harassed 2 CAs as alleged. Chartered Accountants have called for a protest against the arbitrary detention of two chartered accountants by the DGGI, GURGAON.

CGST Department for last 2 days providing an unjust enrichment certificate in a GST refund case. They misbehaved with them, removed their clothes and treated them like criminals/terrorists. Now they have been sent to Bhondsi Jail.

The arrest is illegal and malicious, according to a viral video posted by a group of chartered accountants, because no action is taken against the person who received the refund and the officer who allowed the refund without properly verifying the documents.

The GST department has yet to respond to which section of the Act the Chartered Accountants are being held inside the department without access to legal counsel or other fundamental rights guaranteed by the law.

The basis of charge is a certificate issued by CAs under rule 89(2)(m) of CGST Rules which was used by the client for claiming refund of INR 15.00 Cr. As per the prescribed procedure, refunds are sanctioned based on long list of documents.

“Since the implementation of GST, Chartered Accountants have been scrutinised for fraudulent claims, and the entire profession has been subjected to unnecessary harassment whenever a scam is discovered,” a Chartered Accountant in the video said. “What crime did he (the arrested CA) commit?” “How about sharing an OTP?” they inquired.

“The incident also involved the house arrest of 50 other CA; which is an unjust treatment and should be looked upon.” Another person said.

People claimed it as “Black night in history of Indian Taxation.” All CAs Still there at office 5 ICAI RCM of NIRC also detained.
